A Third FedEx Accident Lawsuit Has Been Filed On Behalf Of An Eighteen Year Old Boy Who Was Killed In The Horrific Accident Involving A FedEx Tractor Trailer And Charter Bus

FedEx-Accident-Lawsuit-Wright-and-Schulte-LLCA third wrongful death lawsuit has been filed against FedEx after a FedEx truck crashed into a bus and killed 10 people in April 2014. According to the LA Times, the Fed Ex accident lawsuit was filed by the family of an 18 year-old teen who was killed in the horrific crash. The personal injury attorneys at Wright & Schulte LLC also learned that the wrongful death lawsuit was filed against FedEx, Silverado Stages and several other companies involved in the deadly crash that occurred in Orland California.

The accident involving the Fedex truck and a charter bus occurred on April 10 when the FedEx truck collided head-on with Silverado stages charter bus killing 20 of the teens and chaperones heading for a tour Humboldt State University in Orland California. According to the accident report, the FedEx driver signaled to change lanes, but never straightened out after the lane change. The driver continued veering off the road across a 58 stretch of median and into oncoming traffic. The FedEx tractor trailer collided head-on with the charter bus, causing the bus and the FedEx truck to burst into flames. 5 students, 3 chaperones, the driver of the bus, and the driver of the FedEx truck were killed. Dozens of additional students were injured. Most of the passengers on the bus were high school seniors on a tour of the campus.

The Jimenez family wrongful death suit is suing FedEx, the manufacturer of the tractor trailer Volvo, the bus company Silverado Stages, and the now-deceased FedEx driver Timothy Evans. The family claims in the lawsuit that Ismael Jimenez was riding at the front of the bus during the accident and at first, was uninjured. According to a witness report cited in the claim, Jimenez was able to escape from the bus and helped others escape from the flames but was eventually trapped in the flames and was unable to save himself from death. In a press statement announcing the lawsuit, Ismael’s sister said, “Honestly, that’s amazing to me that he did that. I mean he could have saved his own life, but he did it for others, and that’s amazing to me.”

This third FedEx accident lawsuit against shipping company FedEx follows two others. The mother of 17 year-old Jennifer Bonilla filed a negligence suit against FedEx in April, claiming that FedEx trucks have a long history of catching fire due to their construction and is seeking $100 million in damages. Survivor Miles Hill and family filed an additional negligence suit against FedEx and Silverado Stages in May. Their suit claims that Hill was traumatized during the crash and subsequent injuries and can only attend school four hours a day. In response to these tractor trailer accident lawsuits, FedEx has a released a statement saying that FedEx is, “focused on providing support to those affected and cooperating with the authorities as they conduct their investigation. This is not the time for us to discuss potential litigation.” According to Inquisitor News, additional lawsuits from the victim’s families and individuals injured in the crash are expected to be filed against FedEx and Silverado Stages over the next several months.
