A personal injury lawsuit was filed today on behalf of the family of Javier Harrison. Javier was A 17 year old Dayton resident who was shot and killed by Victor Santana when he found Javier inside of his garage. The lawsuit details that Defendant Santana entered the detached garage and, despite the fact that there was no danger or threat to his person, his residence, or any other person occupying the residence, Defendant Santana shot Javier three times, causing fatal injuries. The lawsuit alleges that Defendant Santana had a duty to retreat and contact law enforcement. And, as a direct and proximate result of the actions of Victor Santana in causing the death of Victor Santana, Javier Harrison’s mother and siblings have sustained pecuniary loss, economic damages and loss, mental anguish, emotional pain and suffering, loss of society, loss of companionship, loss of comfort, loss of protection, loss of care, loss of advice, loss of counsel, loss of training, loss of guidance, loss of education and loss of filial care.
