Ohio Cancer Cluster Families File Class Action Lawsuit Against Whirlpool Corp after Test Find Chemical in Local Attics, Wright & Schulte LLC Report
The families of children living in the Ohio Cancer Cluster who have been sickened with various forms of cancer in the small town of Clyde, Ohio have filed a federal class action lawsuit against Whirlpool Corp., after tests found benzaldehyde, a possible cancer causing chemical compound in dust samples in five local homes.
The experienced personal injury and wrongful death attorneys at the law firm of Wright & Schulte LLC are reporting that a Ohoi Cancer Cluster class action lawsuit has been filed in the U.S. District Court for the Northern District of Ohio Western Division by the families of children sickened with various forms of cancer after environmental test found the presence of the chemical compound benzaldehyde in the homes of five families, include one of the plaintiffs, whose 11-year old daughter died from cancer in 2009. 27 plaintiffs filed the lawsuit alleging that the chemical compound benzaldehyde, used by Whirlpool in a washing machine factory in Clyde, Ohio, an area now deemed a cancer cluster by state and federal health officials, could be the cause of the cancer outbreak, which has sickened at least 40 children and teens since the middle of the 1990s. The higher levels of chemical then allowed by law were found in the homes after the families involved in the cancer cluster brought in a private company to conduct environmental testing that included testing sludge in a water reservoir, a water treatment plant, and dust in the attics of five homes in Clyde, Ohio, where Whirlpool has a washing machine factory. According to the South Bend Tribune, the U.S. Environmental Protection Agency (EPA) tested soil from the Whirlpool Park, located near the town of Clyde, and reported that soil samples showed high levels of a chemical compound believed to cause cancer; however, the agency did not link the chemical to the cancer cluster.
Whirlpool issued a statement saying the company would “vigorously defend itself, its employees and the community against the allegations,” the South Bend Tribute reported. The families are seeking damages against Whirlpool of at least $5 million, and want the appliance giant to test and clean area attics.
